Terms & Conditions

Welcome to magenCRM. These Terms of Service (“Terms”) govern your access to and use of our platform, services, and applications (collectively, “the Service”), operated by magenCRM (“we,” “us,” or “our”).

By signing up or using magenCRM, you agree to be bound by these Terms.
 

1. Description of the Service

magenCRM is a SaaS platform that allows synagogues and Jewish congregations to manage their members, send automated notifications based on the Jewish calendar, and streamline communications via email and WhatsApp.
 

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of your synagogue or organization to use magenCRM.
 

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. We provide multi-user access with role management. You agree to notify us immediately of any unauthorized use.
 

4. Plans and Billing

magenCRM is billed on a monthly or annual subscription basis. Plans are based on the number of records (contacts or special dates). Upgrades or downgrades take effect immediately and will be prorated accordingly.
 

5. Payments and Refund Policy

We process payments through Stripe. All charges are in USD unless otherwise stated.

  • No refunds are offered for partial months or unused portions of service.

  • You may cancel at any time, and your account will remain active until the end of your billing cycle.

  • Free trials (if offered) may be terminated at any time at our discretion.
     

6. Use of APIs and Integrations

You may use magenCRM’s integrations (e.g., SendGrid, Twilio) to connect your own email or WhatsApp Business account. By doing so, you agree to comply with the terms and costs of each third-party service.

We are not responsible for the functionality or performance of external integrations.
 

7. Support and Availability

  • We provide technical support via email and chat.

  • Support is available Monday through Friday, excluding Jewish holidays.

  • We strive for 99.9% uptime but do not guarantee uninterrupted access.
     

8. Acceptable Use

You agree not to:

  • Use magenCRM for illegal or unauthorized purposes.

  • Attempt to breach or compromise the security of the platform.

  • Send unsolicited or SPAM communications.

We reserve the right to suspend or terminate your access if we believe you are violating this section.
 

9. Data Privacy and Ownership

You own the data you upload to magenCRM. We do not share or sell your data. You grant us permission to access your account only as necessary to provide the Service, support, or as required by law.

10. Messaging Services and Third-Party Providers

magenCRM enables users to send automated notifications via email and WhatsApp. These messaging features rely on third-party services—specifically, SendGrid for email and Twilio for WhatsApp messaging. By using these features, you acknowledge and accept the following conditions:

10.1 Email Delivery (via SendGrid)

All emails sent through magenCRM are transmitted using SendGrid, a third-party email delivery provider. Email delivery is subject to SendGrid’s Acceptable Use Policy and anti-spam standards, which may block or delay messages that are flagged as suspicious or violate their guidelines.

  • Email delivery is not guaranteed.

  • magenCRM cannot be held responsible for undelivered emails due to spam filters, incorrect recipient addresses, poor sender domain reputation, or any other technical or policy-related issue.

10.2 WhatsApp Messaging (via Twilio / Meta)

WhatsApp messages are sent using Twilio’s WhatsApp Business API, which is tightly governed by Meta’s approval and compliance process.

  • Messages must comply with pre-approved templates defined by WhatsApp Business policies.

  • If your WhatsApp Business account is not properly verified, or if your templates do not meet Meta’s guidelines, messages may be rejected or blocked.

  • Even with a valid WhatsApp Business setup, Meta’s systems may prevent the delivery of messages for reasons beyond magenCRM’s control.

10.3 Responsibility and Limitations

While magenCRM provides the interface to configure and automate these communications, it does not guarantee the successful delivery of any message sent via email or WhatsApp. Users are responsible for:

  • Ensuring that their email and WhatsApp configurations are properly completed and verified.

  • Following the content and usage guidelines of SendGrid, Twilio, and Meta.

magenCRM is not liable for any direct or indirect loss resulting from failed or delayed delivery of automated messages, even when subscription fees or additional messaging credits have been paid.

11. Termination

We may suspend or terminate your access if:

  • You breach these Terms.

  • You fail to pay on time.

  • We suspect misuse or abuse of the Service.

Upon termination, we will retain your data for up to 30 days. After this period, your data may be permanently deleted.
 

12. Limitation of Liability

To the fullest extent permitted by law, magenCRM shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits or data.
 

13. Modifications to the Service or Terms

We may modify these Terms or the Service at any time. We will notify you by email or via the platform. Continued use after the change constitutes acceptance of the new Terms.
 

14. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
 

15. Language and Translations

These Terms are written in English. Translations may be provided for convenience, but the English version is legally binding.
